Abstract

"Contextualism as a Methodological Alternative for Normative Analysis" by Salvador Hernández Garduño explores how contextualism, originally used for the analysis of political ideas, can be applied to legal practice. This methodological approach proposes overcoming the limitations of traditional textualism, which tends to attribute ideological interpretations to texts without adequately considering the historical context. In the legal field, contextualism would allow for a deeper understanding of norms, overcoming the limited analysis of legislative arguments and the norms themselves. Instead, it advocates considering the historical and social context in which the norms were created to address the increasing complexity of legal problems. This entails recognizing that legal norms are linked to other social and moral norms, and that law alone cannot solve all current social problems.

Salvador Hernández Garduño, Universidad Nacional Autónoma de México

He holds a law degree, a master's degree in Constitutional Law and Human Rights from the Universidad Panamericana, and a master's degree in Law from UNAM. He is a PhD candidate in Law from the UNAM Institute of Legal Research.
