Intrinsic value as an epistemic premise for understanding the rights of nature

Abstract

This article presents a line of argument intended to guide the analysis and critique of the rights of nature in a legal-philosophical context, based on the premise of intrinsic value, derived from theoretical propositions that describe and explain it. This is due to the conceptual confusion that arises in the various intellectual debates among jurists and legal practitioners regarding the identification of the nature, scope, and classification of these rights within legal doctrine and legal studies. Therefore, this academic dialogical process is ambiguous, impeding its proper approach and study.

Author Biography

Alan David Barraza Guerrero, Universidad Nacional Autónoma de México

Master of Laws, with honors, from the UNAM School of Law. He holds a PhD at the Institute of Legal Research at UNAM. He teaches Environmental Law and Sustainable Development at the Law School of the same institution. His research interests include environmental law, legal philosophy, and legal pluralism. He is a practicing attorney in environmental and administrative matters.
